1. Acceptance of Terms

By downloading, installing, or using ME Ally ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Papersona LLC, the owner and operator of ME Ally ("Papersona," "we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

ME Ally is a personal health tracking application designed for individuals with ME/CFS, Long COVID, and related chronic conditions. The App allows you to:

• Track daily health metrics and activity levels
• Log symptoms and their severity
• View analytics and insights about your health patterns
• Review estimates and insights related to your personal energy envelope
• Generate health reports (Premium feature)
• Export and import your data (Premium feature)

3. Medical Disclaimer

IMPORTANT: ME Ally is NOT a medical device and is NOT intended to diagnose, treat, cure, prevent, or improve any disease or medical condition. The App is designed solely as a personal tracking tool to help you review your own logged patterns and optionally share information with your healthcare team.

Papersona does not promise or guarantee that using the App will improve your health, reduce symptoms, prevent crashes or post-exertional malaise, identify the cause of symptoms, or produce any particular medical or wellness outcome.

You should:

• Always consult with qualified healthcare providers about your health concerns
• Not rely on the App for medical decisions
• Seek immediate medical attention for emergencies
• Not discontinue any treatment based on App data without consulting your doctor

The analytics, insights, estimates, and suggestions provided by the App are based on the data you enter and statistical patterns. They may be incomplete or inaccurate. They are not medical advice and should not be treated as such.

4. Eligibility

You must be at least 13 years of age to use ME Ally. By using the App, you represent that you meet this age requirement. If you are between 13 and 18, you should review these Terms with a parent or guardian.

5. User Responsibilities

You are responsible for:

• Accurate Data Entry: The quality of insights depends on the accuracy of the data you enter
• Device Security: Maintaining the security of your device and any passcode/biometric protection
• iCloud Account: Managing your iCloud account if you choose to enable cloud sync
• Backups: Creating backups of important data (Premium export feature available)
• Appropriate Use: Using the App only for its intended purpose of personal health tracking

6. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy points:

• Your health data is stored locally on your device by default. iCloud Sync is optional, free, and off by default—you can enable it during setup or in Settings.
• We do not access, sell, or share your health data
• There are no third-party analytics or advertising in the App

7. Intellectual Property

The App and its original content, features, and functionality are owned by Papersona LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any commercial purpose without our permission

8. In-App Purchases

ME Ally offers a Premium upgrade as a one-time, non-consumable in-app purchase. By making a purchase:

• You agree to pay the listed price at the time of purchase
• Payment is processed by Apple through the App Store
• The purchase is non-refundable except as required by applicable law or Apple's policies
• Premium features are unlocked permanently on your Apple ID
• Family Sharing is supported according to Apple's policies

For refund requests, please contact Apple Support through your purchase history in the App Store.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that the App will be uninterrupted, error-free, or secure

We do not warrant that:

• The App will meet your specific requirements
• Analytics or insights will be accurate for your situation
• Any errors in the App will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPERSONA LLC, ME ALLY, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages resulting from your reliance on the App or its content
• Any health outcomes or medical decisions based on App data

In no event shall our total liability exceed the amount you paid for the App or Premium features in the twelve (12) months prior to the claim.

11. Indemnification

You agree to indemnify and hold harmless Papersona LLC, ME Ally, and their officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

12. Termination

You may stop using the App at any time by deleting it from your device. Your data will remain on your device unless you delete it within the App first.

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Changes to the App

We may update, modify, or discontinue the App or any features at any time without notice. We will not be liable for any modification, suspension, or discontinuation of the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If informal resolution is not successful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Papersona LLC regarding your use of the App and supersede any prior agreements.

19. Apple-Specific Terms

These Terms are between you and Papersona LLC only, not with Apple. Apple has no obligation to furnish any maintenance or support services with respect to the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
